Fees for the Administration of the Toxic Substances Control Act
The American Chemistry Council (ACC) comments to the Environmental Protection Agency (EPA) highlighting considerations and recommendations relating to establishing fees for the administration of TSCA. ACC and its member companies supported the Frank R. Lautenberg Chemical Safety for the 21st Century Act. EPA now has an obligation to screen all chemicals in commerce, evaluate the risks of high priority substances, and regulate certain conditions of use where necessary. The Act also requires EPA to review all claims to protect chemical identity from public disclosure. These Agency activities are typically funded by appropriations, but Congress provided EPA authority to impose fees as a means of defraying some of the Administrative costs associated with implementing the Act.
